Experienced Boston Lawyers Handling Indecent Exposure/Open and Gross Cases

In Massachusetts, public exposure of what are commonly considered “private parts” (buttocks, genitalia, female breasts) is charged as misdemeanor indecent exposure or felony open and gross lewdness, if the exposure was deliberate. While open and gross lewdness carries harsher penalties, both charges can result in fines and possible jail or prison time depending on the circumstances of the case.

Massachusetts Indecent Exposure Laws

Under Massachusetts law, indecent exposure is a sex crime against chastity, morality, decency and good order. It involves the intentional exposure of genitals to one or more other people who were offended by the exposure. If convicted of indecent exposure, you could face up to six months in jail, a fine up to $200, or both. If you are convicted of the felony charge of open and gross lewdness and lascivious behavior, you could face up to three years in state prison or two years in prison with a fine up to $300.

A Zealous and Vigorous Defense

Let us put our experience to work for you. We understand that a conviction for public indecency can cost you your job and connections with family and friends. We will examine the facts of your case and fight to minimize the impact of the charge. If involved early on in the case, we will strive to avoid a conviction, especially if this is your first offense or you did not intend to cause harm. In felony cases, we may negotiate a deal that reduces the charge to a misdemeanor. We are always prepared for trial, however, if taking your case to court to fight the charge is in your best interests.
