Dedham: Shoplifting: Case Dismissed (Prior to Arraignment)
Summary of Facts: Our client was accused of stealing items from a store in the Dedham mall. A loss prevention officer claimed she observed our client enter a dressing room with a number of items and then leave that dressing room without the same number of items. Loss prevention claimed to have then searched the dressing room looking for the additional items without finding any.
Action: Attorney Coughlin informed the client of her right to challenge the case prior to the issuance of a formal criminal complaint. We met with her and her family and explained the process and outlined our defense strategy. At the clerk magistrate’s hearing Attorney Coughlin argued heavily against the issuance of the complaint – citing the lack of evidence, the client’s clean record and her educational and professional goals.
Result: Case dismissed (prior to arraignment or even the issuance of any criminal complaint)
